Use of our website and the purchase of products from our web store constitutes an agreement with our terms and conditions as set forth below. We've endeavored to keep our terms and conditions straightforward; if you have a questions about them please contact us.
Age requirements: You must be at least 18 to order any product from us. By placing an order with Blade Play you represent to us that you are of legal age to own and/or posses and/or use the item purchased. Furthermore you agree that you understand your local laws concerning the ownership, possession and use of any item you purchase. You agree to take full responsibility for obeying all federal, state and local laws, restrictions, and regulations. Some items sold by Blade Play are restricted and may be governed by Federal Law (see Auto Law & Legal Status Terms below).
Credit card orders: We accept Visa, Mastercard, Discover and American Express. We do not accept Paypal. By ordering from Blade Play you represent that you are the legal owner of the credit card used. Furthermore you agree to handle any payment disputes directly with our company and no third party.
Money order and check orders: We accept all types of money orders and personal or business checks. Checks take between 5 and 10 days to clear. You agree to all terms and conditions set fourth in this section when you purchase with a money order or check. We will accept cash, but you send it at your own risk and Blade Play assumes no liability for lost or stolen cash. Where applicable: Domestic Orders: We will ship orders via FexEx, UPS, DHL, or USPS at our discretion. If there is a particular shipping method you need you must state this in the notes box above or contact us before the order ships (applicable shipping charges may apply).
Please note: There are some areas within the USA where we simply cannot ship certain restricted items (i.e. defense sprays, automatic knives, stun guns, knuckles, police batons, etc). These areas include, but are not limited to: portions of Alaska, California, Colorado, Connecticut, Delaware, Hawaii, Illinois, Indiana, Kansas, Louisiana, Maine, Massachusetts, Michigan, Minnesota, Missouri, New Mexico, New York, Tennessee, Texas, Vermont, Washington, and Wisconsin. Exceptions are made as local laws permit (proper ID may be required at the time of purchase).
Where applicable: International Orders:
Please review our shipping policies for International orders. International purchasers assume all risk of loss, theft, or customs seizures and you agree that Blade Play shall not be held liable for loss or seizures.
Please note: There are some areas of the world where we simply cannot ship certain restricted items (i.e. defense sprays, automatic knives, stun guns, knuckles, police batons, etc). Blade Play will sell no stun guns, defense sprays, knuckles, or police batons outside of the USA and no exceptions will be made. You agree to take full responsibility for obeying all government, state and local laws, restrictions, and regulations pertaining to the import, possession, ownership and use of knife and knife related products purchased from Blade Play.
Blade Play makes no guarantees about shipping time. We will do our best to stay within the specified time frames indicated on our website, however exceptions may result (examples of exceptions include but are not limited to: Customer verification, declined credit cards, restricted items, weather conditions, employee sickness, product unavailability, etc). Blade Play accepts no responsibility for loss or stolen packages unless the package has been shipped with a signature required. If you would like your order shipped with a signature required simply indicate this to us in the notes box above (an additional fee of $2 may apply if you have used the free shipping option). By default orders with a value of $100 or more are shipped with a signature required at no additional cost. If you would like your order shipped without a signature required simply indicate this to us in the notes box above. If you waive the required signature on your order you accept all responsibility pertaining to loss, theft or damage.
Errors on this site, Server downtime and Site Updates:
Website mistakes (i.e. pricing errors, knife misinformation, stock discrepancies, etc) are inevitable. Blade Play is not required to honor pricing errors. At our discretion we may cancel any order where we determine there has been a pricing error. If we propagate knife misinformation you have the right to return your purchased product without penalty (subject to the return policy of our website). If there is a stock discrepancy you have the right to retain your order until it can be filled or to cancel your order without penalty.
Periodic website downtime is inevitable and you agree to hold us harmless for unplanned or unexpected outages.
Knife Operation & Warranty
Our guarantee/warranty is that you will get a working product. If you do not receive a working product we will repair or replace it at our discretion at no charge within time frame outlined in our Return & Exchanges. If your product arrives broken you agree that you will not attempt to "try "to fix it yourself (unless you know you can- in which case you need to keep it). We will not replace products that have been "fixed" by the buyer. Additionally we will not replace products that have been not been maintained, broken though neglect or abuse, or otherwise damaged due to unintended use.
Returns, Exchanges, and In Store Credit:
Returns are accepted, as long as they are done within 10 (ten) days of receiving the product (we feel this is enough time to determine if your knife is in operational order and to decide if you wish to keep it). You are responsible for shipping the knife back to us in new condition (or the condition the knife arrived to you in*). When you return a knife you agree to a 15% restocking fee to off set shipping costs, credit card fees and labor costs. We may waive or reduce the restocking fee at our discretion. Restocking fees apply only to refunds, not exchanges or in store credit. Once we receive the knife we will inspect it and we will issue a refund in the medium your payment was received (i.e. if you paid with Visa, your Visa card will be refunded the order price less 15%). Blade Play does not reimburse shipping costs for returns of exchanges unless we are replacing a defective product. Exchanges are welcome as long as they are done within 10 (ten) days of receiving the product. There are no restocking fees for an exchange although shipping charges may apply. Similarly you may return a product for exchange and accept in store credit. You may use this in store credit at any point in the future. In store credit in not transferable between customers. Once again, you are responsible for shipping the knife back to us in new unused condition (or the condition the knife arrived to you in*).
*Please be aware that some of our budget knives are shipped in bulk and may not be cosmetically perfect (small scratches are common). We willy be able to accurately determine the condition the knife was shipped in. We reserve the right to reject a return if the knife has been carried, used or damaged.
Change and Cancellation Policy
If you order the wrong items you may change your order up until the time the order is shipped. Once an order has been shipped if you wish to change an item you must follow the guidelines in the Return & Exchange section (above).
If you would like to cancel your order you may do so up until the time the order has shipped. Once an order has been mailed you must follow the guidelines in the Return & Exchange section (above).
You must contact us about a change or cancellation via email or telephone (801-768-2303) prior to the order's shipment. If you choose to send an email you must use “order change” or “order cancellation” in your email subject to make sure the email is directed to the correct department so the change or cancellation can be implemented before the order ships.
Privacy Policy
No personal information (names, addresses, email addressed, telephone numbers, etc) gathered off our website (from forum registration, orders, newsletter subscribers, personal communication or otherwise) will be sold to anyone at anytime without written permission. Additionally we will not distribute, give or provide your information to anyone at at time except in the case of fraud, criminal action, or abuse (we define "abuse" as the intention or action of harming our company in any way). In such cases as fraud, criminal action or abuse we reserve the right to distribute customer information to parties we deem appropriate for investigation and or prosecution.
All email information acquired from correspondence, purchases or other direct contact may be used to send out company promotions via email. If you do not want to receive promotional material via email simply let us know in the order note box above, notify us by email or give us a call. We will respect your privacy. You can also unsubscribe directly from any email we send at any time.
Auto law & Legal Status Terms
The Switchblade Act, (Pub.L. 85-623, 72 Stat. 562, enacted on August 12, 1958, and codified in 15 U.S.C. § 1241–1245), prohibits shipment of automatic knives across state lines, with the following exceptions:
(1) to civilian or Armed Forces supply or procurement officers and employees of the Federal Government ordering, procuring, or purchasing such knives in connection with the activities of the Federal Government;
(2) to supply or procurement officers of the National Guard, the Air National guard, or militia of a state, territory or the District of Columbia ordering, procuring, or purchasing such knives in the connection with the activities of such organization;
(3) to supply or procurement officers or employees of the municipal government of the District of Columbia or the government of any State or Territory, or any county, city or other political subdivision of a State or Territory; (4) to manufacturers of such knives or bona fide dealers therein in connection with any shipment made pursuant of an order from any person designated in paragraphs (1), (2), and (3).
Sections 1242 and 1243 of this title shall not apply to -
(1) any common carrier or contract carrier, with respect to any switchblade knife shipped, transported, or delivered for shipment in interstate commerce in the ordinary course of business;
(2) the manufacture, sale, transportation, distribution,possession, or introduction into interstate commerce, of switchblade knives pursuant to contract with the Armed Forces
(3) the Armed Forces or any member or employee thereof acting in the performance of his duty;
(4) the possession, and transportation upon his person, of any switchblade knife with a blade three inches or less in length by any individual who has only one arm; or
(5) a knife that contains a spring, detent, or other mechanism designed to create a bias toward closure of the blade and that requires exertion applied to the blade by hand wrist, or arm to overcome the bias toward closure to assist in opening the knife.
Blade Play will not sell to any individual or group outside the State of Utah without the above conditions being met. This does not apply to automatic knives manufactured, distributed, purchased or sold within the state of Utah. Proper identification may be required before the order is shipped in cases where restricted items are purchased.
Legal status of products
Blade Play offers no legal advice regarding your local laws. We have advised you of broader Federal laws that may affect your purchase. It is the responsibility of you, the buyer, not Blade Play, the seller, to ascertain and obey all applicable local, state, federal and international laws in regard to the possession, and use, of any item purchased from Blade Play. All equipment is sold subject to public law 90-351, title III, U.S.C., Section 2511, and any local, state or federal ordinances. Please consult your local and state laws before ordering if you are in doubt (and when in doubt do not make a purchase). Absolutely no sales to minors. By placing an order, the buyer represents that the products ordered will be used in a lawful manner and that the he/she is of legal age to own these products. Blade Play will not be held liable for the misuse of any product purchased from us or any of our distributors & dealers. As applicable: no product is 100% effective against attack and Blade Play assumes no responsibility if a product purchased from us is not effective in preventing bodily injury, dismemberment or death.
Anyone attempting to falsify information or defraud our company in any way will be turned over to the proper authorities. Attempts at extortion, blackmail or entrapment will be met with legal action (ask around- we're aggressive). You agree that if the need arises for potential action against our company you will first attempt to resolve the issue with Blade Play or an agreed upon mediator.
